1.      Trademark Registration and Protection in Cambodia


Introduction:

 

Cambodia become a party to the Madrid Protocol in 2015, which makes it possible to protect a mark in a large number of countries by obtaining an international registration that has effect in each of the designated contracting parties. Trademark protection in Cambodia can be obtained by filing an application to the Ministry of Commerce, Department of Intellectual property (“DIP”) either in Khmer or English. Cambodian law protects trademarks, service marks, collective marks and trade names. Law Concerning Mark, Trade Name and Act of Unfair Competition 2002 defines trademarks as visible signs capable of distinguishing the goods or services of an enterprise. It means that sounds, tastes, smells or other non-visible elements could not be registered as trademarks under Cambodian law.
